Through it, Plaintiffs seek to enjoin the Government from enforcing the Corporate Transparency Act and its Implementing Regulations. Having considered the Motion, the arguments of counsel, and the applicable law, the Court concludes that the Motion should be GRANTED. “Great nations, like great men, should keep their word.” Fed. Power Comm’n v. Tuscarora Indian Nation, 362 U.S. 99, 142 (1960) (Black, J., dissenting). Ours is a written Constitution. The promises it makes to the People and the States alike are not hidden. The Court must enforce them. “The powers of the legislature are defined, and limited: and . . . those limits may not be mistaken, or forgotten, the [C]onstitution is written.” Marbury v. Madison, 5 U.S. 137, 176 (1803).

David Tate was sentenced to 14 years and ordered to go to an alcohol treatment center by Federal Court Judge Bernice Donald. Tate pled guilty to several corruption charges earlier this year. The former police officer admitted taking bribes to tip off strip clubs about vice raids...and bringing women he thought were prostitutes to meet up with high dollar gamblers in Tunica. The former cop also admitted to planning to steal $200,000 from famed wrestler Jerry "the King" Lawler. Tate was allowed to make a statement in court today. During that statement he apologized to his family, the police department and Jerry Lawler. Tate spoke briefly about his new baby, and said he was sorry to bring his father's name into this. Tate's father is News Channel 3 anchor Jerry Tate. Defense attorney Stephen Leffler says 14-years may not sound like a deal, but you have to consider what his client was up against. The feds agreed to drop a separate indictment against Tate involving child porn. Three others involved in the police corruption scandal have not yet been sentenced.Tags: Comments are closed.

The CTA injunction has been lifted, and CTA Beneficial Ownership Reports are voluntary once again.What this is: On December 26, 2024, the Fifth Circuit Court of Appeals reversed its order lifting the nationwide preliminary injunction on Corporate Transparency Act (CTA) enforcement.What this means: This puts the injunction back in effect and makes the filing of beneficial ownership information reports (BOIRs) under the CTA voluntary again while the injunction remains in force.Background:On December 3, 2024, a Texas District Court in the case, Texas Top Cop Shop vs. Garland, issued a nationwide preliminary injunction (“the injunction”) against enforcement of the Beneficial Ownership Information (BOI) reporting requirements of the CTA. As a result of the District Court’s order, from December 3, 2024 to December 23, 2024, FinCEN continued accepting BOIRs submitted on a voluntary basis, but no reporting companies (as that term is defined in the CTA and its implementing regulations) were required to file BOIRs while the injunction was in force, despite the filing deadlines mandated in the CTA’s regulations. The government appealed the District Court’s issuance of the injunction to the Fifth Circuit Court of Appeals (“the Fifth Circuit”), seeking to have the injunction lifted.On December 23, 2024, a motion panel of 3 Fifth Circuit judges granted the government’s appeal and lifted the District Court’s injunction, making BOI reporting under the CTA mandatory again. As a result, FinCEN extended the January 1, 2025 deadline to January 13, 2025 for non-exempt reporting companies in existence prior to this year to file their BOI reports and gave extensions to non-exempt reporting companies created during 2024 whose reports came due while the injunction was in force. Meanwhile, the Texas Top Cop Shop plaintiffs requested a Fifth Circuit rehearing of its December 23, 2024 order lifting the injunction.On December 26, 2024, the Fifth Circuit reversed
